Article 1 (Purpose)

These Terms of Service (the "Terms") govern the rights, obligations, and responsibilities between Mirage AI (the "Company") and users in connection with the use of AI-based services (the "Service") provided by the Company.

Article 2 (Definitions)

The terms used in these Terms are defined as follows:

  • "Service" refers to all services provided by the Company, including AI conversations, voice conversations, image generation, credit system, and subscription services.
  • "User" refers to members and non-members who access the Company's Service and use it in accordance with these Terms.
  • "Member" refers to a person who has entered into a service agreement with the Company and has been assigned a user ID.
  • "Fan" refers to a general user who converses with AI models and generates images.
  • "Creator" refers to a member who creates and operates AI models to generate revenue.
  • "AI Model" refers to a virtual AI persona created by a Creator.
  • "Credits" refers to the virtual payment method used within the Service.
  • "Subscription" refers to recurring payment services provided on a monthly or annual basis.
  • "Voice Conversation" refers to the service of conversing with AI models through real-time voice calls.
  • "Memory" refers to the function that stores information such as preferences and interests identified from conversations with users.
  • "Sponsored Content" refers to promotional materials, product placements, or brand integrations delivered through AI model conversations that are paid for by advertising partners.
  • "Interest-Based Advertising" refers to personalized advertisements displayed based on user preferences, behaviors, and interests inferred from Service usage.
  • "Brand Partner" refers to third-party companies that engage with the Platform to deliver sponsored content or advertisements through AI models.

Article 3 (Effect and Amendment of Terms)

  1. These Terms become effective by posting them on the Service screen or by notifying members through other means.
  2. The Company may amend these Terms within the scope of not violating relevant laws if there are reasonable grounds.
  3. When the Company amends the Terms, it shall specify the effective date and reasons for amendment and post them together with the current Terms at least 7 days before the effective date. However, for changes unfavorable to users, notice shall be given at least 30 days in advance.
  4. If a member does not agree to the amended Terms, they may discontinue use of the Service and withdraw. Continued use of the Service after the effective date of the amended Terms shall be deemed consent to the amended Terms.

Article 4 (Provision of Services)

The services provided by the Company are as follows:

1. Fan Services

  • Text conversation service with AI models
  • Real-time voice conversation service with AI models
  • AI image generation service
  • Personal gallery and conversation history management
  • AI memory function (conversation context retention)
  • Credit purchase and usage
  • Subscription service usage
  • Referral program participation

2. Creator Services

  • AI model creation and management (Studio)
  • AI model persona and personality settings
  • Voice settings and cloning features
  • Scenario and style settings
  • Social media account integration
  • Revenue settlement and withdrawal
  • Usage statistics and analytics
  • Creator affiliate program participation

3. Subscription Services

  • Monthly/annual subscription plans
  • Credits provided by subscription tier
  • Feature restrictions unlocked by subscription tier
  • Priority support service

4. Advertising Services

  • Interest-based personalized advertisements
  • Sponsored content within AI conversations
  • Brand partnership integrations
  • Opt-out controls for personalized advertising

Article 5 (Membership Registration)

  1. Users apply for membership by filling in member information according to the registration form set by the Company and expressing their agreement to these Terms.
  2. Registration is available through email verification or social login (Google, Apple, etc.).
  3. The Company may refuse approval or subsequently terminate the service agreement for applications that fall under any of the following:
    • Cases where the applicant has previously lost membership under these Terms
    • Using a false name or another person's identity
    • Providing false information or failing to provide required information
    • Being under 19 years of age
  4. A separate application and approval process is required to become a Creator.

Article 6 (Credits and Payment)

  1. Credits are a virtual payment method used within the Service for AI conversations, voice calls, image generation, etc.
  2. Credits can be purchased through payment methods (credit card, simple payment, etc.) designated by the Company and are immediately charged to the account upon purchase.
  3. Credit prices and usage conditions are displayed separately within the Service.
  4. Voice conversation services deduct credits per minute, and rates are specified within the Service.
  5. Refunds are available in the following cases:
    • Credits that have not been used within 7 days of purchase
    • When service use is impossible due to reasons attributable to the Company
    • EU/EEA Users: You have the right to withdraw from your credit purchase within fourteen (14) days without giving any reason, unless you have consented to immediate service commencement and acknowledged that you thereby lose your right of withdrawal. To exercise the right of withdrawal, contact us at support@mirage.ai.kr.
  6. Credits are valid for 1 year from the purchase date and expire upon expiration.
  7. Credits provided free of charge (welcome bonus, referral rewards, etc.) are excluded from refunds.

Article 7 (Subscription Services)

  1. Subscription services are provided on a monthly or annual basis and are automatically renewed.
  2. Subscription fees are charged based on the payment date and will be notified in advance if changed.
  3. Subscriptions can be canceled at any time, and upon cancellation, the service can be used until the end of the current billing cycle.
  4. Monthly credits provided according to subscription tier do not roll over and are reset each month.
  5. If a free trial period is provided, it will automatically convert to a paid subscription after the trial period ends.

Article 8 (Referral Program)

  1. Members can invite new members through a unique referral code.
  2. Both the referrer and referee will receive rewards (credits, etc.) as determined by the Company.
  3. Referral rewards are paid upon completion of the referee's registration or first payment.
  4. If rewards are obtained through fraudulent methods (self-referral, fake account creation, etc.), rewards may be recovered and usage may be restricted.

Article 9 (Creator Revenue Settlement)

  1. Creators can receive revenue settlement based on the use of their AI models.
  2. Revenue sharing ratios are subject to separate agreements between the Company and Creator.
  3. Settlement is made once a month, and the minimum withdrawal amount is separately determined by the Company.
  4. Taxes and related costs are borne by the Creator.
  5. Revenue distribution through the Creator affiliate program is subject to separate agreements.
  6. Advertising Revenue: Creators may receive a share of advertising revenue generated through their AI models, subject to separate terms in the Creator Service Agreement. The default revenue share for advertising is 70% to the Creator and 30% to the Company.

Article 10 (Advertising and Sponsored Content)

  1. Interest-Based Advertising: The Service may display personalized advertisements based on user interests and behaviors inferred from Service usage, including conversation content, AI memory data, and interaction patterns.
  2. Sponsored Content: AI model conversations may include sponsored content from Brand Partners. All sponsored content will be clearly labeled with disclosures such as "Sponsored," "Ad," or "Paid Partnership."
  3. User Consent: Interest-based advertising is provided with user consent. Users may opt out of personalized advertising through their account settings without losing access to core Service features.
  4. Data Usage: Advertising-related data processing is governed by our Privacy Policy. We may share aggregated, de-identified interest data with advertising partners but do not sell personal information for monetary consideration.
  5. Creator Participation: Creators may participate in brand partnerships and sponsored content programs subject to the Creator Service Agreement. Creators retain creative control over sponsored content delivery while adhering to Brand Partner guidelines and applicable advertising regulations.
  6. Advertising Standards: All advertisements and sponsored content must comply with applicable advertising laws and regulations, including but not limited to FTC guidelines, KFTC regulations, and EU advertising directives.
  7. Prohibited Advertising: The following types of advertising are prohibited:
    • Advertising for illegal products or services
    • Misleading or deceptive advertising claims
    • Advertising targeting users under 19 years of age
    • Advertising for adult content, tobacco, gambling (except where legally permitted), or weapons
    • Advertising that violates intellectual property rights

Article 11 (Rights to AI-Generated Content)

  1. Copyright ownership of images generated through AI is subject to relevant laws and Company policies.
  2. Users may freely use generated images for personal, non-commercial purposes.
  3. Separate license purchases may be required for commercial use.
  4. Users must not generate the following types of content:
    • Content that infringes on others' portrait rights, honor, or privacy
    • Pornographic content or content related to child abuse
    • Content that promotes violence, hatred, or discrimination
    • Content that infringes on copyrights
    • Deepfake content containing false information
    • Content that impersonates or imitates real people without authorization
  5. The Company has the right to review and delete inappropriate content before or after posting.

Article 12 (User Obligations)

Users must not engage in the following activities:

  • Registering false information when applying for membership or making changes
  • Misappropriating another person's information
  • Altering information posted by the Company
  • Transmitting or posting information other than that designated by the Company (computer programs, etc.)
  • Infringing on the copyrights and other intellectual property rights of the Company or third parties
  • Acts that damage the reputation of or interfere with the business of the Company or third parties
  • Posting obscene or violent messages, images, audio, or other information contrary to public order and morals
  • Acts that interfere with normal Service operations
  • Attempting to generate inappropriate content by abusing the AI system
  • Unauthorized use of the Service through automated means (bots, scripts, etc.)
  • Collecting, storing, or disclosing other users' personal information
  • Activities for illegal purposes using the Service

Article 13 (Restriction of Service Use)

  1. The Company may restrict Service use if a user violates the obligations under these Terms or interferes with normal Service operations.
  2. Usage restrictions may be applied in stages, such as warnings, temporary suspension, and permanent suspension.
  3. The Company shall notify users of the reasons when restricting usage.
  4. Users may appeal against usage restrictions, and the Company shall lift restrictions if there are valid reasons.
  5. Unused credits in permanently suspended accounts may not be refunded.

Article 14 (Member Withdrawal and Disqualification)

  1. Members may request withdrawal at any time through the settings menu within the Service.
  2. Upon withdrawal, the member's personal information and generated content will be retained for a certain period according to relevant laws and then deleted.
  3. Refund requests for unused credits must be made before withdrawal; refunds are not available after withdrawal.
  4. For Creators, any unsettled revenue must be settled before withdrawal.
  5. There may be restrictions when re-registering with the same email after withdrawal.

Article 15 (Service Changes and Suspension)

  1. The Company may change the content of the Service or add new services.
  2. The Company may temporarily suspend all or part of the Service in the following cases:
    • Technical needs such as regular system maintenance, server expansion and replacement, or network instability
    • When normal service provision is impossible due to power outages, equipment failures, etc.
    • Force majeure events such as natural disasters or national emergencies
    • Service suspension by external service providers
  3. The Company shall notify users before or after any service suspension.

Article 16 (Limitation of Liability)

  1. The Company is exempt from responsibility for service provision when it cannot provide services due to natural disasters or equivalent force majeure events.
  2. The Company is not responsible for service usage disruptions caused by reasons attributable to the user.
  3. The Company does not guarantee the accuracy, completeness, or suitability of conversations and images generated by AI.
  4. The Company is not responsible for users not obtaining or losing expected revenue from using the Service.
  5. AI model responses are for reference only and do not replace professional advice.
  6. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL THE COMPANY'S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT PAID BY YOU TO THE COMPANY IN THE PAST TWELVE (12) MONTHS.
  7. EU/EEA/UK Users: The limitation of liability above does not apply to liability for death or personal injury caused by negligence, fraud, or gross negligence. Nothing in these Terms excludes or limits your statutory consumer rights.

Article 17 (Intellectual Property Rights)

  1. Copyright and intellectual property rights related to the Service belong to the Company.
  2. Users may not use information obtained through the Company's Service by means of reproduction, transmission, publication, distribution, broadcasting, etc., or allow third parties to use it without the Company's prior consent.
  3. Copyright of posts created by users within the Service belongs to the respective users. However, the Company may use such posts for Service operation, improvement, and promotional purposes.

Article 18 (Dispute Resolution)

  1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
  2. Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms shall be settled by binding arbitration administered by the Korean Commercial Arbitration Board (KCAB) in accordance with its International Arbitration Rules. The seat of arbitration shall be Seoul, Republic of Korea.
  3. Class Action Waiver: You and the Company agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
  4. EU/EEA/UK Users: The arbitration and class action waiver provisions above are not binding on you if you are resident in the EU, EEA, or UK. You may bring disputes in the competent courts of your country of residence. Nothing in these Terms affects your statutory consumer rights.
  5. Australian Users: Binding arbitration provisions do not apply to disputes that may be brought before Australian consumer protection tribunals.
  6. For other overseas users, relevant international laws and treaties may apply where mandatory.

Supplementary Provisions

  1. These Terms shall be effective from December 10, 2025.
  2. The previous Terms that were effective from January 1, 2025, are replaced by these Terms.
